NESTLÉ Best Dream Vacation Ever Photo Contest OFFICIAL RULES
CONTEST IS OPEN TO LEGAL RESIDENTS OF THE 50 UNITED STATES AND THE DISTRICT OF COLUMBIA, 18 OR OLDER AND SHALL BE CONSTRUED AND EVALUATED ACCORDING TO U.S. LAW. DO NOT ENTER THIS CONTEST IF YOU ARE NOT LOCATED IN THE 50 UNITED STATES OR THE DISTRICT OF COLUMBIA.
Sponsor: Nestlé USA, Inc. (''Sponsor'').
TO ENTER: Log on to verybestkids.com/thanksmom or verybestkids.com/graciasmama between 7:00 p.m. ET on 4/15/08 and 11:59 p.m. ET on 5/31/08, and follow on-screen instructions to register and submit a photo showing you and your family in a way that symbolizes your families’ dream vacation and a caption in 50 words or less, highlighting your vacation request (“Entry”). Example: If your family would like to go skiing in the Rocky Mountains, your photo could be of the family dressed up in ski gear. All entrants must have a valid e-mail address. In case of dispute as to the identity of the winner who enters, entry will be declared made by the registered user (meeting eligibility criteria) of the e-mail account and, if a prize is won, it will be awarded to that registered user. Limit one entry per person, per e-mail address. Entries must be received by and contest ends 11:59 p.m. ET, 5/31/08.
Entry must meet all of the following requirements or it will be disqualified:
- Each Entry must be original, unpublished, the sole property of submitter and not previously submitted in any other contest.
- Submitter must be 18 years or older.
- Entry must not incorporate/display any third party brands or trademarks.
- Entry must not violate any third party rights including, copyright and right of publicity.
- At the judges’ discretion, entries including unsuitable content or that are in violation of third party rights (including, but not limited to, copyrights) will be immediately disqualified.
- All entries must be submitted in English or Spanish.
- Entries submitted in Spanish that are selected as finalists may be translated to English for voting purposes.
- Photo must be in JPEG (.jpg) format and may not exceed a file size larger than 1MB.
- Photo must be in color.
- By submitting an Entry you agree Nestlé has the unrestricted right to use your Entry, commercially or non-commercially, including the right to publish and display the photo/caption for advertising and publicity, all without additional review or compensation.
- All Entries become the property of Nestlé, and may be used without compensation. Please read our Terms and Conditions.
- You must have written permission from any identifiable person who appears in your photo to use his/her likeness in the photo submission. If such person(s) is younger than 18, you must have written permission from minor's parent or legal guardian or if you are the parent or legal guardian, you must consent to his/her appearance in the photo entry.
Judging: Judges will select the top 10 finalists from all eligible entries received based on the following criteria:
Originality (50%)
Demonstrate your dream vacation in a creative and unique manner.
Humor/Emotional (20%)
Caption and/or photo contains a comical or emotionally touching element.
Photo’s relevance to the family vacation theme (30%)
Shows family members with a vacation-themed backdrop or props.
In the event not enough qualified entries are received, Sponsor need not award more prizes than qualified entries received.
Finalists: Finalists will be notified via email on or about 6/24/08. Finalists Entries will be featured on verybestkids.com/thanksmom between 7 p.m. ET on 6/27/08 through 11:59 p.m. ET on 7/18/08 during which time consumers may vote for their favorite Finalists Entry, based on the judging criteria above. Vote as often as you like but limited to one vote per per person, per computer per day.
The finalist who receives the most votes by 11:59 p.m. ET on 7/18/08 will be deemed the Grand Prize Winner, subject to verification. The remaining nine (9) finalists will be determined First Prize winners, subject to verification and meeting Entry and eligibility requirements. Winners will be notified via email and/or phone on or about 8/1/08. Voting through the use of automated processes or scripts will result in discarding all such votes from such person and the system. In the event of a tie, judges will determine the Grand Prize Winner based on the original judging criteria.
Prizes: GRAND PRIZE (1): Grand Prize Winner will receive a Family Travel Vacation Package (“Vacation Package”) of their choice ; a copy of the book, 500 Places to Take Your Kids Before They Grow Up; and $4,000 awarded in the form of a check (ARV up to $10,020). Actual ARV will vary based on place of origin or destination and airfare fluctuation. Vacation Package can not exceed $6,000 and there will be no cash difference provided in the event the Vacation Package booked is less than $6,000. Sponsor will coordinate the initial contact between Grand Prize Winner and the travel agent who will handle all Vacation Package travel arrangements. Travel must be completed by 12/31/09. Any picture identification requirements, passports, visas, immunizations, or other international requirements associated with travel are the winner and their guests' responsibility. Winner and guests must travel together on the same travel itinerary and on dates specified. Travel restrictions and blackout dates may apply. If winner is unable to travel on dates specified and agreed to, prize will be forfeited in its entirety and another winner may be chosen. Sponsor is not responsible for any postponements or cancellations associated with any Vacation Package. Expenses not specifically stated are the sole responsibility of the winner. If guest is a minor, minor must travel with parent or legal guardian.
FIRST PRIZES: Nine (9) First Prize Winners will each receive a copy of the book “500 Places to Take Your Kids Before They Grow Up” (ARV $20).
Odds of winning depend upon the number of eligible entries received. No cash substitutions for prizes will be permitted and prizes are nonrefundable and nontransferable, except at sole discretion of Sponsor. Sponsor reserves the right to substitute prize of equal or greater value. Federal, state and local taxes are the sole responsibility of the winner. Sponsor will report value of prize as required by law. Unclaimed prizes will not be awarded. Total ARV for all prizes is $10,200.
Eligibility: Contest open to legal residents of the 50 United States and the District of Columbia, 18 years or older, except employees and the families of Nestlé USA Inc., Wiley Publishing, their affiliates, subsidiaries, promotions and advertising agencies. Nestlé USA Inc., Wiley Publishing, their affiliated companies, representatives, agents or employees are not responsible for, and shall be indemnified by the prize winner against, any claims, injuries, losses or damages of any kind resulting from acceptance, use, misuse, possession or loss of the prize. Void where prohibited or restricted by law. Subject to all federal, state and local laws.
General: By entering the Contest, entrants accept and agree to these rules and the decision of the judges, which shall be final. Winners and their travel companions will be required to sign a Winner’s Agreement and Release and return it by date specified in notification letter or prize will be forfeited in its entirety and another winner may be selected. Grand prize winner will be required to submit their social security number for tax reporting purposes. By submitting an entry, a winner agrees to allow use of his or her name, Entry and/or photograph for advertising this or similar promotions (including Internet posting) without compensation unless prohibited. All photographs and captions and all rights of ownership and publication of same will become the property of Sponsor and will not be returned.
Other Conditions: Sponsor assumes no responsibility for computer system, phone line, hardware, software or program malfunctions or other errors, failures of any kinds, delayed computer transmissions or network connections that are human or technical in nature. Sponsor reserves the right in its sole discretion to cancel or suspend this Contest, in its entirety or in part should virus, bug, tampering, unauthorized intervention, fraud, technical failures, or other causes beyond Sponsor’s control corrupt the administration, security, fairness, integrity or proper play of the Contest. Sponsor is not responsible for incorrect or inaccurate entry information whether caused by Internet users or by any of the equipment or programming associated with or used in the Contest by technical or human errors, which may occur in the processing of the entries in the Contest. Sponsor reserves the right to withdraw the transmission of this Contest at any time and award the Prize from among eligible entries received prior to the date of the withdrawal. Sponsor reserves the right at its sole discretion to disqualify any individual it finds to be tampering with the entry process or the operation of the game or Web site or to be acting in violation of the Rules.
