CONTEST IS OPEN TO LEGAL RESIDENTS OF THE 50 UNITED STATES AND THE DISTRICT OF COLUMBIA, 18 OR OLDER, AND SHALL BE CONSTRUED AND EVALUATED ACCORDING TO U.S. LAW. DO NOT ENTER THIS CONTEST IF YOU ARE NOT LOCATED IN THE 50 UNITED STATES OR THE DISTRICT OF COLUMBIA.
TO ENTER: Log on to VeryBestKids.com/thanksmom or VeryBestKids.com/graciasmama between 7:00 p.m. ET on 4/15/09 and 5:00 p.m. ET on 5/28/09, and follow on-screen instructions to register and submit a photo showing you and your family enjoying your time together in a room in your house and include a story in 100 words or less, explaining your most memorable family moment in that room (“Entry”). See judging criteria below. All entrants must have a valid e-mail address. In case of dispute as to the identity of the winner who enters, entry will be declared made by the registered user (meeting eligibility criteria) of the e-mail account and, if a prize is won, it will be awarded to that registered user. Limit one entry per person, per e-mail address. Entries must be received by and contest ends 5:00 p.m. ET on 5/28/09.
Entry must meet all of the following requirements or it will be disqualified:

Each Entry must be original, unpublished, the sole property of submitter and not previously submitted in any other contest.

Submitter must be 18 years or older.

Entry must not incorporate/display any third party brands or trademarks.

Entry must not violate any third party rights including, copyright and right of publicity.

At the judges’ discretion, entries including unsuitable content or that are in violation of third party rights (including, but not limited to, copyrights) will be immediately disqualified.

All entries must be submitted in English or Spanish.

Entries submitted in Spanish that are selected as Finalists may be translated to English for voting purposes.

Photo must be in JPEG (.jpg) format and may not exceed a file size larger than 3MB.

Photo must be in color.

By submitting an Entry you agree Nestlé has the unrestricted right to use your Entry, commercially or non-commercially, including the right to publish and display the photo/caption for advertising and publicity, all without additional review or compensation.

You must have written permission from any identifiable person who appears in your photo to use his/her likeness in the photo submission. If such person(s) is younger than 18, you must have written permission from minor's parent or legal guardian or if you are the parent or legal guardian, you must consent to his/her appearance in the photo entry. Proof of written permission must be made to Nestlé immediately upon request.
Judging: Judges will select the top 10 finalists from all eligible entries received based on the following criteria:
Originality of Photo (40%)
Take a family photo that is unique and original.
Written Expression (30%)
Story must be expressed in a humorous or touching manner.
Family Memory (20%)
Show creativity in sharing your family memory.
Photo Relevance (10%)
How relevant is your story to your family photo?
In the event of a tie when selecting the top 10 Finalists, the entry with the highest score in the “Originality” category will be declared a Finalist. In the event that a tie still remains, the entry with the highest score in “Written Expression” will be declared a Finalist. In the event a tie still remains, the entry with the highest score in “Family Memory” category will be declared a Finalist.
Finalists: Finalists will be notified via e-mail on or about 6/29/09. Finalists Entries will be featured on VeryBestKids.com/thanksmom between 7:00 p.m. ET on 7/10/09 through 5:00 p.m. ET on 7/31/09, during which time consumers may vote for their favorite Finalist’s Entry, based on the judging criteria above. Vote as often as you like; however, there is a limit of one (1) vote per person, per day. The Finalist who receives the most votes by 5:00 p.m. ET on 7/31/09 will be deemed the potential Grand Prize Winner, subject to verification. In the event of a tie, judges will re-judge the tying entries based on the original judging criteria outlined above to determine the Grand Prize Winner. In the event a tie still remains the entry with the highest score in the “Originality” category will be declared the winner. If a tie continues, the entry with the highest score in “Written Expression” then “Family Memory” will be declared the winner. The nine (9) remaining Finalists will be deemed First Prize winners, subject to verification. Winners will be notified via e-mail and/or phone on or about 8/13/09. Voting through the use of automated processes or bot scripts will result in discarding all such votes from such person and the system.
Prizes: GRAND PRIZE (1): Grand Prize Winner will receive a Dream Room Makeover Package (“Package”). Package includes $10,000 (to be awarded in the form of a check made payable to the Grand Prize Winner) to be used toward a room makeover. In addition, Grand Prize Winner will receive 3 hours via phone with Professional Design Consultant Libby Langdon and a copy of her book Libby Langdon: Small Space Solutions. (ARV: $10,025) Sponsor will coordinate the initial contact between Grand Prize Winner and the Design Consultant. During the Consultation, the Design Consultant will provide to the Grand Prize winner any recommendations and professional design input as it relates to the room makeover selected by the Grand Prize winner. The Consultation between the Grand Prize winner and Design Consultant must be completed by 5/31/10. Sponsor is not responsible for any postponements or cancellations associated with the Design Consultant. Expenses not specifically stated herein are the sole responsibility of the Grand Prize Winner.
FIRST PRIZES: Nine (9) First Prize Winners will each receive a copy of the book Libby Langdon: Small Space Solutions (ARV $25).
No cash substitutions for prizes will be permitted and prizes are nonrefundable and nontransferable, except at sole discretion of Sponsor. In the event not enough qualified entries are received, Sponsor need not award more prizes than qualified entries received. Sponsor reserves the right to substitute prize of equal or greater value. Federal, state and local taxes are the sole responsibility of the winner. Sponsor will report value of prize as required by law. Unclaimed prizes will not be awarded. Total ARV for all prizes is $10,250..
Eligibility: Contest open to legal residents of the 50 United States and the District of Columbia, 18 years or older, except employees and the families of Nestlé USA Inc., their affiliates, subsidiaries, promotions and advertising agencies. Nestlé USA Inc. and its affiliated companies, representatives, agents or employees are not responsible for, and shall be indemnified by the prize winner against, any claims, injuries, losses or damages of any kind resulting from acceptance, use, misuse, possession or loss of the prize. General: By entering the Contest, entrants accept and agree to these rules and the decision of the judges, which shall be final. Grand Prize Winners will be required to sign a Winner's Agreement and Release and return it by date specified in notification letter or prize will be forfeited in its entirety and another winner may be selected. Grand Prize Winner will be required to submit his/her Social Security number for tax reporting purposes. By submitting an Entry, entrants agree to allow use of their name, Entry and/or photograph for advertising this or similar promotions (including Internet posting) without compensation unless prohibited. All photographs and stories and all rights of ownership and publication of same will become the property of Sponsor and will not be returned.
Other Conditions: Sponsor assumes no responsibility for computer system, phone line, hardware, software or program malfunctions or other errors, failures of any kinds, delayed computer transmissions or network connections that are human or technical in nature. Sponsor reserves the right in its sole discretion to cancel or suspend this Contest, in its entirety or in part should virus, bug, tampering, unauthorized intervention, fraud, technical failures, or other causes beyond Sponsor’s control corrupt the administration, security, fairness, integrity or proper play of the Contest. Sponsor is not responsible for incorrect or inaccurate entry information whether caused by Internet users or by any of the equipment or programming associated with or used in the Contest by technical or human errors, which may occur in the processing of the entries in the Contest. Sponsor reserves the right to withdraw the transmission of this Contest at any time and award the Prize from among eligible entries received prior to the date of the withdrawal. Sponsor reserves the right at its sole discretion to disqualify any individual it finds to be tampering with the entry process or the operation of the game or Web site or to be acting in violation of the Rules.
